Terms and conditions

This page (together with the documents referred to in it) tells you the terms and conditions (Terms) on which we accept your entry placed for an event which we, Iconic Cycling Events (the trading name of Breathing Space Activities Limited), organise either via any of our websites or in person.

Please read these Terms carefully and make sure that you understand them before placing your entry. You should understand that by submitting your entry form (Entry Form), you, on behalf of yourself and each person registered on your Entry Form, agree to be bound by these Terms. If, for any reason, you do not submit an entry form but still take part in an Event, your participation in the Event will be deemed agreement to the Terms that relate to your participation.

Where you are entering more than one person, you confirm that you are authorised to make each of the statements below on behalf of each person being registered and are responsible for ensuring that each such person is aware of these Terms and complies with them.

In these Terms:

Cycling Equipment means any equipment you may use in an Event, including clothing, helmet, safety equipment and bicycles.

Entry Fee is the fee payable and/or paid in relation to entry to an Event whether to Iconic Cycling Events directly or to a third party on our behalf.

An Event, is an event or events that you are entering either via one of our websites or in person.

Event Centre means the location of the Event headquarters, where the Event starts and finishes, and includes any associated venue facilities, car parks and exhibition space.

The Event Organiser is Iconic Cycling Events and includes anyone delegated by Iconic Cycling Events to take responsibility for any element of an Event.

The Rules are the technical regulations, guidelines, byelaws and anti-doping laws of British Cycling and the Union Cycliste Internationale (where applicable).

You or I means the person completing the Entry Form and/or participating in the Event and, where you are responsible for a minor under these Terms, includes such minor.

You make the following statements:

I will be at least 16 years old on the date of the Event and am entering my own details, or am the parent or legal guardian of a child that I am entering into the Event on their behalf.

Riders under the age of 18 will require a parental consent form and will have be accompanied by a responsible adult.

I understand that confirmed entry to the Event is dependent on a fully and accurately completed online Entry Form either online or in hard copy at the Event and receipt of payment to cover my Entry Fee. Through my completion and submission of an online Entry Form, I am committing to pay the relevant Event Fee via the means instructed on the Website.

I accept that all correspondence and enquiries about the Event shall be directed to the relevant Event Organiser.

I understand that Event Fees cannot be refunded under any circumstances and I acknowledge that Event entry is personal to me and that I may not exchange it with or sell it to or transfer it to any other person without the prior permission of the Event Organiser.

I understand that each Event will be run under the Rules. I agree to comply with the Rules and any other rules stipulated by the Event Organiser, including these Terms, and will at all times act in a professional and cautious manner and may be disqualified if I do not, in which case, I will not be entitled to a refund of my Entry Fee.

I understand that it is my responsibility to understand and abide by the Rules before, during and after the Event and I agree that the decision of the Event Organiser will be binding and final in all circumstances.I accept that the Event is not a race in any format. Rider times may be published for individuals only and anyone considered to be competing against others, will be stopped from riding and may be banned from entering future events. Where selected Events include timed sections riders will be advised of the details in advance.

I accept that it is my responsibility to provide and use suitable Cycling Equipment and that I will wear a safety approved cycling helmet at all times when riding during the Event. The Event Organiser’s decision is final as to whether Cycling Equipment is suitable and may disqualify me if I do not comply.

Where timing chips are provided at an Event, it is the intention of the Event Organiser that each participant is able to obtain a rider time after the Event but this is not guaranteed. It is my responsibility to ensure that my timing chip is functioning correctly and my rider number is fitted to my Cycling Equipment even if a member of the Event Organiser’s team helps me in fitting either of them.

I understand and agree that I participate in the Event entirely at my own risk, that I must rely on my own ability in dealing with all hazards and that I must conduct myself in a manner that is safe for myself and all others throughout the duration of the Event, including at the Event Centre before and after the Event itself.

I accept that, in relation to my participation in the Event, the function of the marshals, contractors and volunteers at the Event is only advisory. I also accept that the relevant signage is only to indicate direction and warnings and not that a particular section is rideable or not and that absence of any sign does not indicate there are no dangers approaching. I must decide if my riding is safe.Any marked route is shown for guidance only. If, during the Event, I decide to change my route or distance, then all consequences of my actions are mine.

During my participation in the Event, I will cycle with care and attention and will abide by the Rules, the UK Highway Code and any other rules stipulated by the Event Organiser. I understand that the Event Organiser has requested that I ride in single file where appropriate and no more than 2 abreast at any time. I will always indicate my intention to stop or change direction.I acknowledge that participation in the Event is physically strenuous and demanding. I am aware of the nature of the Event and associated medical and physical risks involved. I further certify that I am physically and mentally capable of participating in the Event, having taken medical advice to confirm this, and am capable of completing the Event within the cut off time (as decided by the Event Organiser). I will only participate in the Event if I am fit enough to do so.If I have any medical conditions, including allergies, which the Event Organiser or Event medical advisors might need to be aware of, I undertake that I have provided details of these on my Entry Form.

I accept full liability and responsibility for any medical expenses or any other fees or costs incurred as a result of training for and/or participating in the Event including fees or costs from the police, air ambulance, any rescue service and/or ambulance service and connected with repatriation. If I am not capable of making a decision to call any emergency service, I agree that a member of the Event Organiser’s team or a member of the public may do so and I still accept such fees or costs.

Whilst I agree to return to, or call, the Event Centre, should I decide not to, or am unable to, finish the Event or to otherwise report my not completing the Event to an appropriate member of the Event Organiser’s team, I understand that not doing so may result in a search being organised and that I may be billed for any subsequent costs.

The Event Organiser takes every care with the staging of the Event, I accept that I must take all reasonable precautions for the safeguarding of my person and property during my participation in the Event. Although the event itself is covered by insurance, insurance cover and third party claims is not provided to individuals in relation to personal injury or property damages claims. I further acknowledge that personal accident and personal items insurance is my responsibility and both are strongly recommended by the Event Organiser.

It is a condition of any Event that takes place outside the United Kingdom that riders are covered by an appropriate level of travel insurance.

I accept that the Event Organiser reserves the right to amend the Event format, change the route or even cancel the Event due to health and safety reasons or other reasons outside its reasonable control (including storm, rain, inclement weather, winds or any other act of nature, industrial action, threat of terrorist attack, fire, impossibility of use of infrastructure, vandalism). I accept that my Entry Fee shall be non-refundable in such circumstances and that the Event Organiser will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the Terms that is caused by events outside its reasonable control.

Liability – your particular attention is drawn to this section of the Terms.

Subject to paragraph 23 below, neither Iconic Cycling Events nor any other person involved in the organisation of the Event, will be liable for (a) for any injury that you may suffer as a result of your failure to comply with these Terms or your participation in the Event, whether prior to, during, or subsequent to the Event; or (b) for any losses that fall into the following categories (even if such losses result from our deliberate breach): (i) loss of income or revenue; (ii) loss of business; (iii) loss of profits; (iv) loss of anticipated savings; (v) loss of data; or (vi) waste of management or office time; and that (c) the liability of Iconic Cycling Events will otherwise be limited to the amount of your Entry Fee.

You agree to indemnify Iconic Cycling Events and any other person involved in the organisation of the Event, in respect of any cost and expense (including legal and professional fees) incurred or payable by Iconic Cycling Events or such other person (including to any insurer) in connection with any accident, loss, damage or injury arising out of your participation in the Event, or any minor for whom you are responsible, save where Iconic Cycling Events or any other such person would be liable under paragraph 23 below.

Nothing in these Terms excludes or limits the liability of Iconic Cycling Events or any other person involved in the organisation of the Event for (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the obligations implied by section 2 of the Supply of Goods and Services Act 1982; (d) any deliberate breaches of these Terms that would entitle me to terminate the Terms; or (e) any other matter for which it would be illegal for them to exclude or attempt to exclude their liability.

Permissions

As part of the process of registering for an Event, you will need to consent for Iconic Cycling Events to process your personal data in order for us to administer your entry. You may also opt in about relevant products or services and research, including feedback. You can opt out at any time via the unsubscribe links in the emails you are sent or by contacting us by email or phone. Our contact details are below.

You give your irrevocable consent to your appearance in any media format, in relation to the publicity of the Event, and in future publicity and advertising of Iconic Cycling Events. You also agree to assign and grant the right and permission for Iconic Cycling Events to use and publish any photographs, film, video, electronic representations and/or sound recordings of you on any Iconic Cycling Events activity. You hereby release Iconic Cycling Events from any and all liability from such use and promotion. You also authorise the reproduction, sale, copyright, exhibit, broadcast, electronic storage and/or distribution of such photographs, film, video tapes, electronic representations and/or sound recordings without limitation at the discretion of Iconic Cycling Events. You specifically waive any right to any compensation you may have for appearing in any of the photographs, film, video, electronic representations and/or sound recordings of you at an Iconic Cycling Events event.

We use secure payment facilities for all online purchases which are provided by our third party provider, Eventrac, and are subject to its terms and conditions which will be provided to you at the point of payment.Your personal details (including but not limited to name, gender, date of birth, email address, postal address, and mobile and/or landline telephone number) will be stored electronically by Iconic Cycling Events and its registration partner, Eventrac. Your name may appear on the public list of participants and result list for the Event. By entering the Event, you consent to Iconic Cycling Events and Eventrac being given access to your data and the transfer of that data to be processed solely for the purposes connected to your registration for the Event.

Other terms

All decisions and rulings by the Event Organiser, its employees and its agents are considered final.

The Event Organiser reserves the right to vary these Terms effective immediately upon posting on the website relating to the Event.We refer you also to our privacy policy and our website terms of use which can be found on our website (www.iconiccyclingevents.co.uk) or available on request.

These Terms (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event. You acknowledge and agree that in submitting the Entry Form you do not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person (whether party to this agreement or not) other than as expressly set out in these Terms.

To the extent permitted by law, all provisions of these Terms shall be severable and no provision shall be affected by the invalidity or unenforceability of any other provision.A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction.
